These roles qualify for non cap H1B's
* Renewals of existing H1b's
* If are working for a not for profit institution
* If you are working for a institute of higher education ( as defined by the US education act of 1964, institutes like 2 yr and 4 year colleges and some high schools which have teacher education programs with schools of education in these colleges) or a government research institution or a company associated with the above institutions where the primary objective of the company is to supplement the mission of the institutions, example would be a company providing research assistants to a reseach medical hospital. In this case the company is not cap exempt but the job involves the institution that is cap exempt.
What kind of institution will your wife be a financial analyst in?
I am not an attorney, pls consult an attorney regarding your specific case. Hope this information helps.

what do u mean by

does this means that if company files for appeal the 485/ead will be denied and revoked?

...how's it look where you're at? :)
Also, the second picture is uncropped from the camera, I kind of like the frame
the background creates, but do you think it should be cropped tighter?

You Can work for the same Employer On H1 even after entering US on AP.
It is NOT clear Yet if we can file for H1 Transfer with another employer after entering US on Advance Parole.
Please let us know if anybody has done this successfully.

When one should feel to donate, they can donate. Doesn't mean that you donated, means everyone should donate.
It is about donation, not Haptaa-vasooli.....
So, before taunting anyone you should understand the meaning of "Donation".
Hold on .... I am NOT taunting any one . Even I did not contribute for many months . I had a major conflict with many IV members including Papu regarding some of IVs objectives.
While I still hold my views , I can see IVs effort in other directions as well and that made me contribute to specific efforts.

Hi
My status has changed recently from H4 to H1. I haven't got my H1 visa stamped in passport. I need to travel to India due to family emergency.
1. Can I get an emergency appointment?
2. Would I have any problem related to transit visa if travelling via Amsterdam or Frankfurt?
3. How long does it take to recieve the passport after stamping?
Any help would be greatly appreciated.

Exactly the same thing happed to me a few years ago while hiking in the adirondacks, upstate NY. If you are within 100 miles of the border the "border patrol police" has the authority to perform immigration checke on you. This is in contrast to local/state police who under-law, cannot ask you for your immigration documents. There is always patrolling on I87 near the border.
While my status was legal, my records were not up to date in one of their data bases. I was questioned on my status. The officers were stern but cooperative and eventually let me go.
I was asked to keep originals of my travel documents all the time. At the least, keep phtocopies in the car if you are nearing the international broder and keep the phone number of your attorney handy.

Can you please adivse on the following:
My wife is currently on H4.
She has a H1b approved for 3 years to start working on October 1, 2007.
Now, she gets a EAD (though my I-485) to start working on September 1, 2007 valid for 1 year only.
She has a job and the company would like her join asap.
Questions are:
1. Will her EAD (I-485 pending) cancel her H1B approval for the company?
2. Can she work only Sept 1 - Spet-30 on EAD and then fall-back on her H1B (Oct 1 - later) for next 3 years?
We know that H1b is approved and all set for 3 years but Green-Card-EAD is only valid for 1 yr only and sometimes renwal takes time and $$ and bit riskly. So we cant decide if we should stick to her alreay approved H1b or fall back on EAD.
Please advise folks.

Dude i think you have WAYYYY overestimated the processing times!!
I think I might have ....I will not be surprise if they establish BECs for all of these ...:) BECs for AP, BECs for EAD and BECs for 485 ...
The guys who dint have experience with BECS in labor stage will see what BEC means. People like me have to experience more than once ...
If CIR passes in its current form forget about GC for 15 more years ....:D :D :D :D :D :D :D :D :D

Okay, I got so much helpful advice on the last one, try this shot!
I was heading into yosemite just before sunrise and caught the pre-dawn light over Half Dome. But your eye is able to discern a different dynamic range depending on where you focus, so the picture looks different than I saw the scene. For example, the sky is bright and fiery, but I have lost almost all contrast on the mountain itself. Is that a problem from a photgraphic viewpoint? I'm pretty sure it must be, but maybe it's pleasing enough as is, or you all can advise me on some post-processing to spiff it up. All help appreciated :)

can you show me a single post in IV that states that they have travelled after applying for AP, and come back with an AP. May be I missed it.
the rule states that you have to be present in the country when you apply for AP. It does not say anything on where you need to be when it is approved. There are many cases where the applicant left the US to have the document mailed or taken along with someone to the person out of the US. The applicants on return were not asked anything. It was business as usual.

You will retain your PD.
If your employer recalls the 140 it could casue potential disruptions. If you have an EAD, just port your employment to some other employer. That way you will be dealing with less hassles.

You folks can apply for a Canadian immigration for yourself. It would take atleast 6 months. While she can live on Canadian bording city such as Windsor, and you can work in Detroit, MI. Detroit and Windsor are about 2 miles from each other, and I know many ppl who live in Windsro and work in Detroit.
